1. Introduction
Welcome to HistoryAndHeritageHub ("we," "us," or "our"). The following Terms & Conditions ("Terms") regulate your use of our yachting services and the website at historyandheritagehub.site, maintained by HistoryAndHeritageHub.
Your reservation or use of our Service indicates your acceptance of these Terms. Should you reject any portion of these terms, you are not permitted to utilize the Service.
2. Service Overview
HistoryAndHeritageHub offers exclusive yacht chartering services, which include, but are not restricted to:
- Chartering yachts for daily use
- Evening pleasure cruises
- Executive getaways
- Exclusive gatherings
- Extended excursions
Availableness of services is contingent upon various factors, and we retain the right to amend or cease services at our sole discretion.
3. Booking and Reservations
3.1 Booking Process
For charter reservation, you are required to:
- Reach the minimum age of 18 years
- Submit valid and precise details
- Make a payment of the requested deposit as outlined in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A booking is considered confirmed only with our written acknowledgment and the receipt of payment. We reserve full discretion to decline service to any person.
3.3 Availability
Charter availability is dependent on the vessel's schedule and suitable weather conditions. We will endeavor to fulfill your requested charter dates and timings whenever feasible.
4. Payment Terms
4.1 Pricing
All quoted prices are in € and include all applicable taxes unless specified otherwise. Notice will not be provided for any changes in prices.
4.2 Payment Schedule
- Deposit: Payable at 50% of the total cost at the time of booking
- Balance: Payable 48 hours prior to the departure of the charter
- Any incidental expenses (as applicable): Payable following the conclusion of the charter
4.3 Payment Methods
We process payments using secure, encrypted platforms and accept major credit cards, wire transfers, and certified cheques.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If canceled more than 72 hours prior to departure: entire amount refunded, less any transaction charges
- If canceled within 24 to 72 hours before departure: 50% refund provided
- If canceled less than 24 hours prior to departure: non-refundable
5.2 Weather Cancellations
In the event that our captain deems weather conditions as unsafe, we will propose to:
- Reschedule the charter to an alternative day at no extra charge
- Return the full sum if rescheduling is not achievable
5.3 Mechanical Issues
If there arises a mechanical malfunction with the designated yacht, our efforts will be directed towards arranging a suitable replacement. In the absence of a substitute, a complete refund will be processed.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Follow all directions given by the crew
- Make use of the safety gear when necessary
- Communicate any health conditions that might impact their safety
- Stay within the designated areas on the yacht
6.2 Prohibited Items
Onboard, the below items are strictly forbidden:
- Containers made from glass
- Illegal substances
- Weapons or similar dangerous items
- Excessively large quantities of drinks (beyond sensible consumption)
- Pets (unless approved prior)
6.3 Conduct
Guests need to conduct themselves respectfully. Should guest behavior compromise safety or disrupt other patrons' experiences, we reserve the right to halt the charter early and without any reimbursement.
7. Liability and Insurance
7.1 Our Liability
We're only liable up to the cost of your charter. We are not accountable for:
- Injuries resulting from guest carelessness
- Loss or damage to personal belongings
- Indirect or consequential damages, or punitive losses
- Hold-ups due to weather or unexpected events beyond our control
7.2 Insurance Coverage
HistoryAndHeritageHub maintains thorough marine insurance covering our watercraft and operations. It is the responsibility of passengers to secure their own travel and personal insurance arrangements.
7.3 Assumption of Risk
By partaking in our charter services, you're acknowledging the intrinsic risks associated with marine activities and you agree to accept personal responsibility for your safety and any risks.
8. Modifications and Itinerary Changes
We hold the right to alter itineraries, paths, or schedules due to weather factors, safety needs, or operational necessities. We will aim to deliver equivalent alternative experiences as much as possible.
9. Force Majeure
We bear no liability for postponements, cancellations, or changes derived from circumstances outside of our control, which encompasses, but isn't restricted to:
- Extreme weather conditions
- Natural calamities
- Regulatory decrees
- Closures of harbors
- Technical malfunctions
10. Privacy and Data Protection
Your private information will be treated in compliance with our Privacy Policy. Participation in our services equates to consenting to data collection and utilization as detailed in our Privacy Policy.
11. Intellectual Property
All content on our web domain, inclusive of but not limited to text, graphics, logos, and imagery, is protected by laws governing copyright and trademarks. Unauthorized reproduction, dissemination, or generation of derivative works is strictly prohibited without our express permission.
12. Governing Law
These Terms are subject to the laws of Spain. Any disputes shall be addressed in the judiciary of Barcelona, Spain
